This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.visualartspassage.com .

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use this Order Information to:

Communicate with you;

Screen our orders for potential risk or fraud;

Applications;

email communication and provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

WHAT IS OPTING IN?

Whenever a user participates in a Visual Arts Passage event, course, class, webinar, uses any platform hosted or managed by Visual Arts Passage, completes a form, application, registration, contact Visual Arts Passage by phone, email, or message, you are providing consent for Visual Arts Passage to collect, store, and use your data.

HOW TO DECLINE YOUR CONSENT

If after you opt-in, you would like to withdraw your consent, you can unsubscribe from any email you receive from Visual Arts Passage and you may also email hello@visualartspassage.com with the subject line ‘WITHDRAW MY DATA CONSENT’, and include the relevant email and contact information related to your data in the email.

SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above.  For example, we use WordPress, Paypal, Affirm, and Stripe to power our online store–you can read more about how WordPress uses your Personal Information here:  https://wordpress.org/about/privacy/.  We also use Google Analytics to help us understand how our customers use the Site–you can read more about how Google uses your Personal Information here:  https://www.google.com/intl/en/policies/privacy/. This includes, but is not limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages.  We do not sell any customer information collected or submitted to Visual Arts Passage or The Illustration Academy. We reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide us information in connection with the Visual Arts Passage, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If, in our sole discretion, we believe that any such information is untrue, inaccurate, or incomplete, or you have opted into the Program for an ulterior purpose, We may refuse you access to Visual Arts Passage and pursue any appropriate legal remedies.

BEHAVIOURAL ADVERTISING

Visual Arts Passage Forums/Slack Channels and Discord Servers

If you participate in a Visual Arts Passage discussion, Slack channel, Facebook group or chat room, you should be aware that the information you provide there could be made broadly available to others, potentially inside or outside Zoom, who have access to that data. Also, recognize that individual channels, groups, and chat rooms may have additional rules and conditions. Each participant’s opinion on a forum or chat room is his or her own and does not reflect the opinion of Visual Arts Passage. All communication connected to Visual Arts Passage is recorded and can be used for any purposes necessary and could be made visible publicly for promotion or other purposes.

Classes, Webinars, Online Meetings, and Online Portfolio Reviews Using Zoom:

If you use a feature of the Products that allows for Recordings, such as any class, recording, or webinar, we collect information from you that you provide in connection with such use and through such Recordings, to the extent you provide it to us. This information may include Personal Data, if you provide us with Personal Data during a class, workshop, webinar via chat, video, audio or digital screen sharing. This personal information may be shared publicly and made visible to the public. We are not liable for any date you may intentionally or unintentionally share during our online classes. Users are liable for anything malicious they share during any online event and Visual Arts Passage and The Illustration Academy is not responsible for anything shared by any attendee, panelist, instructor or participant. All online events are recorded.

Our Website uses Memberspace for membership verification in relation to our services.

Transfer and Storage of Personal Data

Our Products are hosted and operated in the United States (“U.S.”) through WordPress and its service providers. We may transfer your Personal Data to the U.S., to any Visual Arts Passage affiliate worldwide, or to third parties acting on our behalf for the purposes of processing or storage. By using any of our Products or providing any Personal Data for any of the purposes stated above, you consent to the transfer and storage of your Personal Data, whether provided by you or obtained through a third party, to the U.S. as set forth herein, including the hosting of such Personal Data on U.S. servers.

EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield

Visual Arts Passage participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield. Visual Arts Passage is committed to subjecting all Personal Data received from EU member countries and Switzerland, in reliance on the Privacy Shield Frameworks, to the Framework’s applicable Principles. Visual Arts Passage is responsible for the processing of Personal Data it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. Visual Arts Passage complies with the Privacy Shield Principles for all onward transfers of Personal Data from the EU and Switzerland, including the onward transfer liability provisions.

With respect to Personal Data received or transferred pursuant to the Privacy Shield Frameworks, Visual Arts Passage is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Visual Arts Passage may be required to disclose Personal Data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, please contact our U.S.-based third party dispute resolution provider (free of charge) at https://feedback-form.truste.com/watchdog/request.

Under certain conditions, more fully described on the Privacy Shield website, you can invoke binding arbitration when other dispute resolution procedures have been exhausted.

Standard Contractual Clauses
